Your Rental Agreement:
Please read and accept these Terms and Conditions before making payment, which constitutes your agreement. If you have questions or concerns, contact us. We reserve the right to refuse rental if you do not provide a driving license or for other valid reasons. The agreement takes effect upon accepting the vehicle and these terms.

Vehicle Availability:

We will strive to provide the exact make and model reserved, but similar or upgraded vehicles may be substituted if necessary.

Identification:
You must present your driving license each time you hire a vehicle, along with two additional forms of ID, including a utility bill or official letter dated within the last three months. A contact number is also required.

Driving License Requirements:
All drivers must hold a current, valid driving license. UK license holders must present both the photo card and paper counterpart (if applicable). Foreign drivers need their national license and an International Driving Permit (IDP) if from outside the EU/EEA. Proof of entry via passport is required for non-UK residents. We will retain copies of this information for three years as per legal requirements.

Eligibility Criteria:
1. Aged 25-75.
2. Full UK/EU license for a minimum of 2 years.
3. No license suspension in the last three years.
4. No more than one fault incident in the last three years.
5. Maximum of two convictions with no more than three points each.
6. No BA, DD, or UT convictions.

Additional Drivers:
Three additional drivers can be insured for £40 each, provided they meet our requirements.

Fuel Policy:
Return the vehicle with the same fuel level as when rented. Classic cars require Super or Premium unleaded fuel. A £25 refuelling charge applies if the level is below the original. No refunds for excess fuel.

Gift Vouchers:
Vouchers must be paid in full at purchase, valid for 12 months, non-transferable, and non-refundable. You may extend your voucher for £95 for a further year within its validity date

Hiring Period:
Normal rental periods are 9am-6pm or 24-hour. One hour is allowed for check-out. Late returns incur a £50 per hour charge.

Payment:
The full rental cost plus a £1500 pre-authorisation is required before vehicle release. This amount holds for 7-10 days and is automatically released. Payment methods accepted are credit/debit cards or bank transfers.

Your Responsibilities:
– Safeguard the vehicle and keys; lost keys incur a £150 charge.
– Lock the vehicle when not in use and use provided security devices.
– Protect the vehicle from weather damage.
– Use the correct fuel type.
– Do not sell, rent, or dispose of the vehicle.
– Inform us of any faults immediately.

In Case of an Incident:

  • If any vehicle is damaged during your hire, we will retain your pre-authorisation until the insurer resolves the matter.
  • If a third party is found liable and all insurer matters are cleared, your pre-authorisation will be refunded after deducting external costs and any insurance excess.
  • Hirers are fully liable for cosmetic or mechanical damage caused by negligence, including engine or clutch failure due to misuse.
  • Report any incident or suspected issue immediately. Failure to do so may forfeit your pre-authorisation and incur further charges.
  • Do not admit fault at the scene. Collect names and addresses of all parties and witnesses.
  • Secure the vehicle, contact the police if anyone is injured or there is a dispute, and call our office immediately.
  • You must complete an incident report upon return or provide verbal details, which must be verified and signed. Incidents must be reported within 24 hours or the pre-authorisation will be lost.

Conditions for Vehicle Use:
Only authorised drivers with valid licenses may operate the vehicle. Prohibited uses include:
– Commercial purposes without insurance extension.
– Illegal activities or racing.
– Driving under the influence or outside the UK without permission.
– Exceeding weight limits or towing without consent.

Returning Vehicles:
Check for personal belongings before return. Vehicles must be returned during opening hours. Late returns incur a £50 per hour charge. You are liable for any damages or cleanliness issues.

Our Responsibilities:
We maintain our vehicles to at least the manufacturer’s recommended standard and ensure they are roadworthy at the start of each rental. However, faults can still occur unexpectedly, and we are not liable for issues that arise despite proper maintenance.

  • Some classic cars may lack front and/or rear seatbelts due to their age and legal exemptions. Please ensure the vehicle meets your needs before booking.
  • We are not responsible for indirect or unforeseeable losses (e.g. loss of profits or opportunities).
  • In the event of a breakdown, we will attempt to resolve the issue promptly. If a fix isn’t possible, we will provide a classic replacement vehicle within 3 hours and recover the faulty one at no cost. Refunds are not offered if the original car is repaired quickly or a replacement is provided within this timeframe.

Weather Conditions:
If adverse weather is forecast, we will discuss options for rescheduling or cancelling with a full refund.

Cancellation Policy:
To cancel your booking. The following sets out your contractual rights to cancelling your booking with us.

  • If the start of your hire period is more than 28 days from the date of booking you may cancel your booking within 7 days of making your booking and receive a full refund less an administration fee of £50.00 or If you cancel your booking between 28 and 15 days before the start of the hire period you will be entitled to a refund of 50% or
  • If you cancel your booking within 14 days of the start of the agreed hire period, then no refund will be made.

    We work out charges using our current price list.

You will pay the following charges:

  • The rental and any other charges we work out according to the agreement;
  • Any charge for loss or damage due to you not keeping to your responsibilities;
  • A refuelling service charge of £25 plus the fuel if you have used and not replaced the quantity of fuel that we supplied at the start of the original rental. The charge will be based on the current fuel rates;
  • All fines and court costs for parking, traffic, or other offences (including any costs which arise if the vehicle is clamped). You must pay the appropriate authority any fines and costs if and when the authority demands this payment. If you do not, you will be responsible to pay our administration charges, which arise when we deal with these matters on your behalf;
  • A loss-of-income charge, when we demand it, if we cannot rent out the vehicle because it needs to be repaired or it is a write-off (can’t be repaired);
  • Any published rates for delivering and collecting the vehicle;
  • Any vehicle excess
  • Interest which we will add every day to any amount you do not pay us on time, at the rate of 5% a year above the base lending rate of Barclays Bank PLC; and Value Added Tax and all other taxes on any of the charges listed above, as appropriate.

Miles are capped at 80 miles per 24 hr period and will be charged at £1.50 per mile in excess of that limit.

You are responsible for all charges, even if you have asked someone else to be responsible for them.

Best&Berg will not offer any form of refund or be obliged to offer a replacement vehicle due to an accident, late vehicle collection, early vehicle return, weather or act of God except in the case of a breakdown whereby an agreed suitable replacement vehicle could not be supplied within 3 hours of the reported incident.

Your pre-authorisation total will be retained in case of an incident. This will be used to cover any costs incurred by Best&Berg inclusive of the insurance excess.

If you wish to cancel your booking for any reason at all you will forfeit your deposit. If you choose to cancel your booking or you do not complete your booking you will also be charged the percentage of the total booking shown relative to our set timescale below:

More than 2 months – Deposit retained
Within 2 months – 50%
Within 6 weeks – 75%
Within 4 weeks – 100%

Ending the agreement:

If you are an individual, we will end this agreement immediately if we find out your belongings have been taken away from you to pay off your debts, or a receiving order has been made against you. We may end this agreement if you do not meet the main requirements of this agreement. If you are a company, we will end this agreement immediately if:

  • You go into liquidation;
  • You call a meeting of creditors;
  • We find out that your goods have been taken away from you until you pay off your debts; or
  • You do not meet any of the conditions of this agreement.

If we end this agreement it will not affect our right to receive any money we are owed under the conditions of this agreement. We can also claim reasonable costs from you if you do not meet the main requirements of this agreement. We can repossess the vehicle (and charge you a reasonable amount) without using unreasonable force or causing damage.

Data Protection:

You agree that we may use any information you have given us to carry out our own market research. If you break the agreement we can give this information to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), Police, debt collectors and any other relevant organisation. In becoming our customer you will receive correspondence from us in regards to your booking and may receive newsletters. To pass up on discounts and special offers and to cease all communications with us after your hire simply opt out via the correspondence.

Governing Law:
This agreement is governed by the laws of the country where signed. Disputes will be settled in local courts.

Severance:

If any provision of this Agreement is held invalid, illegal or unenforceable for any reason by any Court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if this Agreement had been agreed with the invalid, illegal or unenforceable provision eliminated.

Please note that cover is subject to the expiry date on the cover note. If the date and time is overlapped with the return of the vehicle, contact must be made with us to extend cover to ensure continuation of insurance cover.

The Insurance cover is invalid if hire has been paid for in total in cash.

In placing a booking, you adhere to this agreement. You also agree to all terms and conditions specified by our insurers, accept that we make take payment from the pre-authorised amount for additional charges and insurance excess in case of an accident and accept the vehicle as described in the accompanying ‘check out’ documentation.

By booking, you agree to these terms and acknowledge your understanding of our insurance coverage conditions.
